According to the New York State Police, State Police in Fulton responded to a domestic incident investigation at a residence on Mullen Road in the town of Volney during the evening hours of May 3, 2026.

Investigators say the incident occurred earlier that evening and involved a physical altercation between a 21-year-old male and a 16-year-old male. During the altercation, police allege a firearm was displayed and discharged in close proximity to the victim before the incident escalated into a physical assault.

Authorities say the victim sustained injuries during the incident.

Members of the State Police Bureau of Criminal Investigation and uniformed personnel responded to the scene to conduct interviews, process evidence, and recover a firearm believed to have been involved in the incident.

State Police identified the suspect as Nickolas Gartner, age 21, of Volney. Police say Gartner was arrested and charged with:

  • Criminal Possession of a Weapon in the Fourth Degree
  • Menacing in the Second Degree
  • Reckless Endangerment in the Second Degree
  • Harassment in the Second Degree
  • Endangering the Welfare of a Child

Authorities say Gartner was transported to the Oswego County Jail pending arraignment. Police say he was later released on his own recognizance following court proceedings and is scheduled to appear in Volney Town Court at a later date.

State Police also reported that a Temporary Extreme Risk Protection Order was obtained as part of the investigation.

At this time, no additional information has been publicly released regarding the condition of the victim or any additional circumstances surrounding the incident.
